The Capital Requirements Regulation (CRR) regulates parts of the supervisory requirements for credit institutions and financial services institutions in a directly applicable EU regulation for the first time. You can get an overview of the most important regulations with seminars MaRisk.
The CRR, on the other hand, is essentially limited to regulations that require the involvement of national supervisory authorities, such as the granting or revocation of authorisations, supervisory intervention powers and sanctions, and the Pillar II Supervisory Review and Evaluation Process (SREP).
Although the directly applicable EU regulation will not be implemented nationally, the existing national law must be cleared of all competing regulations or regulations that conflict with the EU regulation. In addition to the German Banking Act (KWG), this concerns in particular the Solvency Regulation (SOLVV) and the Large Exposures and Million Loans Regulation (GROMIKV).
National implementation also remains necessary with regard to those institutions within the meaning of the KWG that do not fall directly within the scope of CRD IV because they are not deposit-taking institutions.
